The Office of Labor Standards and Enforcement (“OLSE”) announced on March 24 that due to the COVID-19 pandemic, they will be postponing until October 1, 2021, the annual reporting requirements under the San Francisco Health Care Security Ordinance (“HCSO”), among other requirements. Typically, employers with employees in San Francisco are required to file an annual report with the OLSE, usually by no later than April 30th, that reflects their compliance with the required health care expenditures under the HCSO for the prior calendar year. This announcement extends that deadline for 2020 reporting only.
The announcement notes that the San Francisco Board of Supervisors is considering legislation would permanently suspend the annual report for 2020 only. However, that legislation has not been enacted. Unless it is, employers should intend to report by the October 1, 2021.
Finally, this extended reporting deadline does not change any other compliance obligations under the HCSO for 2020 or any other year. Employers with employees in San Francisco should continue their other compliance obligations.
