Coverage Details
Coverages available through the Physiosure program include:
- Professional liability ($5 million per Claim; annual aggregate limit of $5 million)
- Legal expenses against any professional conduct claim ($100,000 sublimit)
- Criminal investigation expenses (successfully defended) ($100,000 sublimit)
- Counselling expense arising out of sexual abuse (up to $10,000)
- This program is not affiliated with any association or college, and as such, there are no fees required to access it.
Note: This policy has no deductible. Policies under PhysioSure are claims-made. It will provide you with coverage only for claims made against you during the policy period arising out of professional services provided. Claims that are brought against you after your policy has expired are not covered. This is why it is very important to renew your policy every year. Most E&O policies are "claims-made".
In the event of individual cancellation, all premiums are fully retained
Automatic discovery period
If you retire or cease to practice in the physiotherapy profession for any reason, you will need to retain some professional liability coverage to protect against any claims made against you for wrongful acts that took place while you were practicing.
- Physiotherapists: Your coverage can be extended for a period of time stipulated by the regulations of your provincial regulatory college, but only for wrongful acts committed before the date on which your practice ceased. For coverage to apply, we must receive written notice within 10 days of your practice ceasing.
- Physiotherapy assistants: This coverage can be purchased upon request, we must receive written notice together with payment of the additional premium within 30 days of your practice ceasing. Once this coverage has been purchased, it cannot be cancelled and the premium is non-refundable.
Parental leave
You are required by your regulatory college to maintain insurance as long as you are an active registrant. If you take parental leave, your coverage can be extended for a period of 18 months following the start date of your leave but only for wrongful acts committed before that date. For coverage to apply, we must receive written notice within 10 days of the start of your leave.
If you’re an independent contractor or self-employed, it’s important to protect yourself with a commercial general liability policy in the event that someone is injured (by a slip or fall, for example) at the location where you practice.
Please familiarize yourself with these important points about our commercial general liability policy for physiotherapists and physiotherapy assistants:
- If you are an independent contractor, we strongly recommend that you review the contractual obligations of your service agreements to ensure you are meeting the coverage and limit requirements.
- If you practice in your home, note that business-related activities are not covered under a homeowners’ policy. If a patient is injured while visiting your home practice, you will not be covered for the associated liability unless you purchase a commercial general liability policy.
- If, as part of your business, you go into your client's homes or visit clients in long-term care facilities, it is imperative that you purchase a commercial general liability policy to protect against most common types of claims.
